I wouldn't bother until someone from Microsoft says its legal, otherwise it isn't legal in my eyes, Microsoft has gone through great lengths to make sure only OEMS can deploy/sell this.

the new version coming out is 2005, not 2004, they are probably just selling an illegal copy or a copy of XP Pro as that is what MCE 2004 is based on. Time for someone to email Microsoft and ask them what they think, they have a special email address for this, but I don't remember it. Of course, I am hoping I am wrong here.
